Montana Payday Loan Lending Laws
Per Montana State Law Mont. Code Ann. 31-1-701, payday loans are restricted. Although technically legal, lenders are not allowed to charge more than 36% APR. Maximum loan amount is $300 for a period no longer than 31 days. No rollovers, extensions, or renewals are allowed. Non-sufficient funds (NSF) fees are capped at $30.
As of 2006, Montana had more than 104 payday lending locations. Today the number of licensed operators is lower since the Montana state legislature has put caps on how much interest a lender can charge. Internet searches are still strong though – in early 2017, “payday loans Montana” turned up 1,700,000 hits.
Individual states are primarily the ones in charge of regulating lending institutions. The cash advance lending industry floats atop the often rocky legal seas. While lenders lobby ardently to enable cash advance lending practices, their equally impassioned detractors lobby to prohibit short-term loans under the guise of consumer protection.
